Apart from the logo problems – resembles the logo of a small Spanish town, remember? – there’s also the small big thing about the name resembling that of a Chinese fast fashion brand and being exactly the same as a New York fashion house that’s been in operation for over seven years. Meghan Markle’s Brand As Ever Banned From Selling Clothes For This Reason
American Riviera Orchard is a thing of the past. In its place is the shiny new – though controversy-driven – As Ever.
On Feb. 18, the 43-year-old announced the name change, but new legal documents reviewed by Daily Mail has revealed certain setbacks she could encounter if she continues to push forward with the brand name.
Meghan’s lifestyle brand is not in the fashion and clothing department, this is true, but reports have stated that she had considered branching into making aprons and other clothing items like it under the brand.
Sadly, this won’t be happening, as, according to the US Patent Patent and Trademark Office (USPTO), her brand cannot operate in the “clothing category.”
Due to this, USPTO partially rejected her application, citing the risk of confusion between her brand and the Chinese one.
“The marks are identical in sound and virtually identical in appearance and are thus confusingly similar for the purposes of determining likelihood of confusion,” the USPTO added in reference to ASEVER.
This means that Meghan will likely stick to selling food products like jam, kitchen utensils and cleaning materials.
According to the former actress, she filed to trademark As Ever in 2022, saying that the name means “‘as it’s always been’, and if you’ve followed me since 2014 with The Tig, you know I’ve always loved cooking and crafting and gardening — this is what I do,” she said, in reference to the lifestyle blog she ran as a passion project from 2014 to 2017.
As for the reason she forewent American Riviera Orchard, she explained that it “limited me to things that were just manufactured and grown in this area.”
