Y&R: How Diane Jenkins Nearly Avoided Jail

The Young and the Restless fans have questions about Diane’s supposed jail time. They want to know how she was able to avoid it. One user brought it up on the Soap Central forums. The original poster didn’t understand why Diane was able to avoid prison time for faking her own death, which is the same thing that Phyllis did.

Other Y&R fans took to the thread to share possible theories. One noted that it’s a soap opera in which some characters get away with crimes while others don’t. Some noted that Diane was forgiven by her family and they didn’t bother to press charges.

“My guess is ‘because it’s a soap opera’… or they could just say the charges were dropped or a statute of limitations kind of thing. However, IRL, she’d probably be in the slammer,” one fan noted.

“Many fans have been asking that question since Diane returned to Genoa City. They also question how Diane and Jack Abbott (Peter Bergman) are not prosecuted for setting up Jeremy Stark (James Hyde) for the necklace theft in Chicago. Some questions are never answered on this show,” another noted.

The Young And The Restless: Will Phyllis Summers Get Away With It?

This brought up questions as to whether Phyllis will get away with her crimes. Some of the Young and the Restless fans believe that she shouldn’t go to jail for what she did. They argue that faking your own death is not a crime. However, faking your own death and setting it up as murder is a crime.

This is the difference between Diane’s and Phyllis’ scenarios. There were multiple suspects involved in Diane’s death, while Phyllis set someone else up for murder, which is an actual crime. The way that Diane’s character was rewritten was a way to “resurrect” her character and bring her back to the show.

However, Diane and Deacon Sharpe (Sean Kanan) did set up Nikki Newman (Melody Thomas Scott), but the statute of limitations ran over the years. The reason why Diane got away with going to jail is that it happened a long time ago. Diane gets away with most things, while Phyllis always ends up in a deeper mess.
