Everything Elizabeth is trying to confess could very well be hearsay without witnesses and evidence, and all the PCPD has is a scorched Christmas ornament. Victor Cassadine (Charles Shaughnessy) cleaned up all the evidence in the north tower room at Wyndemere Castle where Esmé Prince (Avery Kristen Pohl) was held. Esmé herself has traumatic amnesia, and doesn’t remember anything from before she crawled onto the Haunted Star and fainted, if she even remembers fainting.
As for Nikolas Cassadine, (Adam Huss) who held Esmé captive thinking she was The Hook, because he wanted the baby, he’s disappeared and actually dead. The only one who’s telling this tale is Elizabeth herself, and there’s no physical proof or witnesses to back up her confession.
Scott comes into the Port Charles Police Department with Elizabeth ready to confess, but tells Robert he thinks he can make his life a whole lot easier. Scott and Elizabeth both are likely unaware of the events that took place on Spoon Island and at Wyndemere in the last twenty-four hours.
Alexis Davis (Nancy Lee Grahn) publicized the events in the Invader as soon as she was allowed to give details, but then, maybe Scott and Elizabeth don’t read it. Heather Webber (Alley Mills) being proven to be the Hook-as far as Alexis and Austin Gatlin-Holt (Roger Howarth) are concerned-muddy the waters of Elizabeth’s confession, the reason for Esmé’s captivity moot. But there may be no reason for taking her confession, and Robert’s got bigger fish to fry, Heather for instance; Esmé can’t be prosecuted as long as she’s got amnesia.
Of course Elizabeth worries about what will happen to her boys – even though Scott promised to look after them if she’s in prison. Scott likely wishes she’d never told him, but she was intent on doing the right thing and coming clean. A conscience cleanse like that could mean that her children will pay for Elizabeth’s sins along with her, but he couldn’t convince her not to confess.
Robert doesn’t really have to think very much before deciding it’s not much of a case. There are people who make confessions to things all the time who can’t be proven guilty in court because of no sufficient evidence-Robert declines to prosecute and Elizabeth is grateful.
