Amber Heard Blames Jury Member For Losing Trial

Amber Heard is not yet over her defamation case loss against ex Johnny Depp that left her owing the “Pirates of the Caribbean” star over $8 million. The jury declared Depp the winner in all three counts of his defamation case and awarded him $15 million, but the judge reduced it to $10 million due to a Virginia law capping punitive damages.

Heard’s Team Calls For A New Trial After They Discovered Wrong Juror Answered the Summons

Amber Heard’s legal team is calling for a mistrial in the Johnny Depp defamation case after they claimed that one of the jurors who decided the case was never summoned for jury duty.

On Friday, Heard’s team filed a new claim “based on additional discovered facts.” According to a redacted copy obtained by the media, the wrong person joined the jury during the trial.

The shocking claim details how two people with the same last name live at the address where the summons was sent in April: one a 77-year-old individual and the other a 52-year-old. It said that the older individual was the one called to serve, but rather the younger one showed up instead. The document continued by saying that it goes to prove that the jury members were not carefully vetted by the court.

The motion read: “Thus, the 52-year-old sitting on the jury for six weeks was never summoned for jury duty on April 11 and did not ‘appear in the list,’ as required.”

The filing then explained the process in place to prevent these types of mixups, such as the use of a 7-digit juror number, zip code and birthdate to verify jurors’ identities.

“Those safeguards are in place and relied upon by the parties to verify the identity of the correct juror, to ensure due process and a fair trial for all litigants,” reads the filing. “When these safeguards are circumvented or not followed, as appears to be the case here, the right to a jury trial and due process are undermined and compromised.”

Demanding Heard’s right to “rely on the basic protection … that the jurors in this trial would be individuals who were actually summoned for jury duty,” her lawyers are currently seeking to throw out the previous trial and order a new one.

The case was brought on by Depp in 2019, after he claimed that Heard’s 2018 op-ed for the Washington Post caused serious damages to his acting career, even though the 36-year-old actress did not mention him by name.

At the time, Heard said that she just wanted Depp to move on from their “past lives together”. However, even through the defamation case that saw the former lovers rip into one another, Heard still maintains that she loves him.
