October 21, 2021 will go down in movie history as the date on which a routine film-making venture turned into a horrifying tragedy. On that day, Alec Baldwin held a gun to make the movie “Rust” look authentic. But as the late cinematographer Halyna Hutchins, 42, stood with director Joel Souza, that gun got discharged. As a result, Hutchins died and Souza got injured.
And now a new court filing claims that Baldwin, 63, sought to persuade the “Rust” crew and cast to continue filming the movie. In that filing, Alec’s lawyers claim that the actor thought the movie’s profits combined with an insurance payment could support Halyna’s husband Matthew Hutchins and their son, 9. Those documents appear to follow Matthew’s recent lawsuit for the wrongful death of his wife.
In his separate legal filing, Matthew alleged that Baldwin “and the other Defendants in this case failed to perform industry standard safety checks and follow basic gun safety rules while using real guns to produce the movie Rust, with fatal consequences.” But Alec’s attorneys allege that the actor bears no financial liability for the tragedy. That statement appears based on Baldwin’s contract as star and producer.
Alec Baldwin’s legal team describes the actor as possessing no control over hiring or the allocation of budget funds. And Alec claims that he did not pull the trigger of the gun. In addition, Baldwin stated that he did not know the gun contained live bullets.
As for whether the actor feels responsible, he offered a statement stepping back from the tragedy. “Someone is responsible for what happened, and I can’t say who that is, but I know it’s not me,” summed up the actor. And Baldwin went even further in removing himself from responsibility. “I don’t have anything to hide,” he added.
But Alec did express sorrow for the cinematographer’s death. “[I] would go to any lengths to undo what happened,” shared Baldwin. But a response from Matthew Hutchins discounted the actor’s declaration of sorrow.
“Watching him, I just felt so angry,” stated Halyna Hutchins’ widowed husband. “I was just so angry to see him talk about her death so publicly in such a detailed way.” In addition, Matthew expressed frustration at watching Alec “not accept any responsibility after having just described killing her.”
The newest legal filings pit Matthew Hutchins against Alec Baldwin. In response to Baldwin claiming he does not feel responsible for Halyna’s death, Matthew retorted, “There were a number of industry standards that were not practiced, and there’s multiple responsible parties. The idea that the person holding the gun and causing it to discharge is not responsible is absurd to me.”
But Alec’s lawyers paint a different picture of Matthew’s emotions. “Before Hutchins’s appearance on the Today show, his interactions with Baldwin had only been polite, collaborative and, at times, even warm,” claimed Baldwin’s attorneys. “Someone is culpable for chambering the live round that led to this horrific tragedy, and it is someone other than Baldwin. This is a rare instance when the system broke down, and someone should be held legally culpable for the tragic consequences. That person is not Alec Baldwin.”
