General Hospital spoilers tease that Samantha McCall’s (Kelly Monaco) bench trial will have a date assigned to it on the court calendar soon and Attorney Diane Miller (Carolyn Hennesy) will masterfully defend her!
Jason Morgan (Steve Burton) had Bryce Henderson (Brian Gross) ready to admit he was paid off to frame Sam as Shiloh Archer’s (Coby Ryan McLaughlin) murderer, which would have gotten the heat of the feds off Sam and gotten her released, but then Pentonville authorities put him in a cell with Ryan Chamberlain (Jon Lindstrom) who stabbed him to death with an ink pen after he made lewd remarks about Ava Jerome (Maura West)! There went the case down the tubes – or has it?
General Hospital viewers know that Diane has ways to either find other proof to exonerate Sam or refute the sworn statement Bryce Henderson gave before he died. But the wording “masterfully defends” implies she does some pretty fancy legal footwork to convince the judge that Sam is innocent, or at least to prove reasonable doubt of her guilt! All it takes for a defense attorney to win a case is to prove there is a reasonable doubt that the client committed the crime to win the case! Viewers will recall that prior to Bryce getting that call from Peter August (Wes Ramsey) to frame Sam, she was released for lack of evidence of murder.
Commissioner Jordan Ashford (Briana Nicole Henry) disregarded the recording brought in by Daisy Kwan (Kelsey Wang) because Damian Spinelli, (Bradford Anderson) working with the Port Charles Police Department’s forensic audio technician, was able to prove it was doctored, and Nurse Sherri Cottle’s (Jerin Forgie) testimony was disregarded as well. Sam shot Shiloh in the back with a flare gun to save Jason’s life and give Jason the upper hand over Shiloh, and Shiloh stumbled over the side of the deck of the Haunted Star and drowned. Period! She may bring these original facts and outcomes to court for the judge to review and find some additional criminal records on Bryce Henderson into play as well, and argue that even if he had lived to testify, because of his prior criminal records, he would have been an unreliable witness. Of particular interest would have been any fraud convictions, since fraud is all about lies!
Diane will likely argue that Nurse Sherri Cottle is an unreliable witness also, having eavesdropped through a closed door to obtain her damning testimony; even a cop would have to have a warrant to get that kind of testimony considered in a court of law! Otherwise, it is only hearsay and illegally obtained at that! Plus, Diane may discover that the nurse was a follower of Shiloh Archer or perhaps even a Dawn of Day member, making her testimony prejudicial. The term “prejudicial” means, in legal terminology, that it would prejudice Nurse Sherri against Sam in favor of Shiloh and the Dawn of Day. It sounds like Diane will indeed get the charges dropped and Sam will soon be free!
